These terms and Conditions apply to the activities of the company "Rpair OÜ", (Harju maakond, Tallinn, Kesklinna Linnaosa, Parnu mnt 141,11314), carried out from the site www.rpair.online, or from the Rpair mobile application.
By accessing this site or this application, you declare that you have read these terms and conditions and our policy on the protection of personal data (https://www.rpair.online/privacy-policy), understand their scope and accept them.
These pages and their content are made available to you only for your personal and non-commercial use, which remains subject to the terms and conditions presented below.
Please note that Repair Service Providers own, declare applicable and offer their own terms and conditions and rules for the use, access and consumption of the Repair Service (which may include some exclusions and limitations of their liability).
Rpair is not an open platform where end users can make their services available (it is not a C2C platform). We do not allow products and / or services to be offered through our Site and our Application without our express consent. 2. Definitions
Rpair", "the company Rpair" or "we" means Rpair OÜ, a private limited company registered in Estonia at the following address: Harju maakond, Tallinn, Kesklinna Linnaosa, Parnu mnt 141,11314.
"The Site" or "our Site" means the website www.rpair.online which is owned, controlled, managed and powered by Rpair.
The Application" or "our Application" means the Rpair mobile application downloadable from https://play.google.com/store and which is owned, controlled, managed and powered by Rpair.
"Repair Service" means the repair service which can be offered by Repair Service Providers.
"Repair Service Provider" means the repair service provider the information on which is available via the Application.
3. Scope and definition of our obligations
By our Application, we provide an online portal through which visitors of the Application can search for Repair Service Providers contact information. The information offered to visitors is taken from Rpair's database created on the basis of open sources information about Repair Service Providers.
When using a Repair Service, you enter into a direct contractual relationship with the Repair Service Provider. We only offer you some information concerning possible Repair Service Providers. Rpair does not (re) sell and does not offer any Repair Services.
The information we provide to you about the Repair Service Providers is based on open sources and is available to everyone. Although we endeavor to provide the most accurate and relevant information, we cannot neither verify, nor guarantee the accuracy, precision or completeness of this information, and we cannot be responsible for any errors (errors manifest or typographical errors), any imprecise, misleading or erroneous information, or any lack of information. Our Application does not constitute and should not be considered as any form of recommendation or proof of the quality, level of service, or rating of the Repair Service Providers, unless explicitly stated otherwise.
The information accessible on our Application is only available for private and non-commercial use. You may not therefore resell, use, copy, monitor (for example, by web crawler or screenshots), display, download, reproduce any content or information, any software, and / or any products or services available on our Application and / or our Site within your commercial or competitive activity or with commercial or competitive objectives.
4. Liability and intellectual property rights
Unless otherwise provided by national law applicable, neither we nor our officers, executives, employees, representatives, partners, agents or other persons involved in the creation, sponsorship, promotion or provision of the Site and / or the Application and its contents, cannot be held responsible for (i) any loss or any punitive, special, indirect or consequential damages, loss of production, loss of profit, loss of income, loss of business opportunity, loss or damage to the brand or reputation, or loss of the right to compensation; (ii) any inaccuracies relating to the information regarding Repair Service Providers made available on our Application; (iii) any services provided or products offered by the Repair Service Providers or our business partners; (iv) all damages, losses and costs (punitive, special, indirect or consequential) suffered or paid by you, attributable to, arising out of or related to the use of our Application and / or Site, the impossibility of its use or its slowdown; or (v) any bodily injury, death, property damage or other damage, loss or cost (direct, indirect, special, consequential or punitive), suffered or paid by you, whether due to (legal) acts , errors, breaches, (gross) negligence, willful professional misconduct, omissions, breach of contract, misrepresentation of the facts, harm or strict liability attributable (in whole or in part) to a Repair Service Provider or to one of our business partners, the information of which has become available to you through our Site or / and on our Application.
Rpair is not responsible for (and disclaims all liability in this regard) the use, validity, quality of the services of the Repair Services Providers, and does not assume any representation, warranty or condition therein, whatsoever tacit, legal or otherwise, including any implied warranty of quality, title, non-infringement. Rpair is not acting as a (re) seller or trader of Repair Services. Any complaint or claim regarding the Repair Service should be directed to the Repair Service Provider. Rpair is not responsible for these complaints and claims, and accepts no liability in this regard.
Unless otherwise specified, the software necessary for our activities and/or made available on our Site and Application, as well as the content, information and materials of our Site and our Application are the objects of the intellectual property rights (including copyright) of Rpair or / and its partners. Rpair (or its partner) remains the sole owner of all rights, titles and interests (relating to all intellectual property rights) of the Site and the Application (including their presentation and infrastructure). Therefore, you are not allowed to copy, publish, promote, market, integrate or otherwise use our content (including translations) or our name without our express written permission. Any illegal use or any of the aforementioned actions will constitute a material violation of our intellectual property rights (including copyright and database rights).
The provisions of this §4 apply to all professional and non-professional persons and all the visitors of Site and our Application.
5. Laws in force, dispute resolution

If the issue is not solved, you can also address your complaint to the European Commission's online dispute resolution platform. If any provision of these Terms and Conditions is or becomes invalid, non-enforceable or non-binding, you remain bound by all other provisions established in these conditions. If this is the case, the invalid provisions shall be applied unless otherwise provided by the applicable national law and you agree to comply with provisions which would have the same effects as the invalid, non-enforceable or non-binding terms of these Terms and Conditions.
